Indian Ministry of Finance refuses to impose anti-dumping duties on Chinese raw material drugs

The drug product anti-dumping tax is adjudicated.

The report said that this is the second time that the Ministry of Finance of India refuses the anti-dumping and anti-dumping measures proposed by the General Administration of Taxation, mainly because of concerns that imposing anti-dumping duties will adversely affect the domestic pharmaceutical industry in India.

In July 2009, India launched an anti-dumping investigation against penicillin G potassium and Chinese-produced 6-aminopenicillanic acid produced in China and Mexico, and made a final ruling in January of this year, arguing that the prices of bulk drugs produced in China and Mexico Below normal value, it causes substantial damage to India's domestic industry and constitutes dumping.

According to the proposal, an anti-dumping tax of US$2.17 will be levied on one billion Chinese units of penicillin G potassium, and an anti-dumping tax of US$2.66 to US$9.28 per kg of Chinese-made 6-aminopenicillanic acid.

According to Indian law, the Anti-Dumping and Consolidated Taxation Administration is the agency responsible for anti-dumping matters and is responsible for investigating and adjudicating anti-dumping cases. However, the anti-dumping tax must be approved by the Ministry of Finance.
