Article 1 In order to strengthen the hygienic management of imported consigned foods, the Interim Provisions are formulated in accordance with the "Food Sanitation Law of the People's Republic of China (Trial)" and the "Trial Measures for the Hygiene Management of Imported Foods".

Article 2 The term "imported consignment food" as mentioned in the Interim Provisions means that the China National Cereals, Oils and Foodstuffs Import and Export Corporation shall entrust foreign (regional) factories (businesses) to foreign guests (referring to 6 kinds of foreigners, foreign Chinese, overseas Chinese, Hong Kong, Macao and Taiwan compatriots). (man) sales of imported liquor, foreign beverages and other foods (hereinafter referred to as imported consignment foods). Similar products imported by other channels do not fall within the jurisdiction of this provisional provision.

Article 3 Import consignment foods shall be submitted to the food sanitation inspection station at the port of entry or the provincial food hygiene supervision agency before the importer signs the import contract for registration. Foreign (regional) food factories (businesses) that sell imported consigned foods to China may also apply directly to the above-mentioned food hygiene supervision agencies in China for registration.

Article 4 The data of the food hygiene inspection institutes of each port shall be submitted to the Food Hygiene Supervision and Inspection Institute of the Ministry of Health upon examination and approval of the provincial food safety supervision institution by the preliminary examination, which shall be responsible for examination, approval, numbering and issuing. Permit work.

The health inspection institute of the Ministry of Health shall complete the registration within 15 days from the date of receipt of the information for approval and certification, and issue a registration communique to all localities.

Article 5 Application for health registrants shall submit the following information:

1. Exporting government production licenses;

2. Government health agencies’ certification of product safety;

3. The owner’s certification of imported consignment food ingredients;

4. Hygiene quality inspection certificate;

5. Product samples (in the smallest package, 3 for each species).

Article 6 When importing consigned food products that have been registered under hygiene, and then signing an import contract, they will not be required to submit the information specified in Article 5 within the period of validity, based solely on the registration certificate.

Article 7 When imported consigned foods that have been registered in hygiene arrive at the port, the port food sanitation inspection office shall be released on the basis of the registration certificate. At the same time, the quality and specifications marked on the spot shall be checked on-site for conformity with the physical object. Inspection is generally not conducted.

For unregistered imported consignment foods, the port food inspection office carries out supervision, inspection, and certification according to the general import food management regulations. Those who do not comply with China's food hygiene standards and regulations may not import.

Article 8 If the technical information submitted during the registration of the registrant is required to be kept confidential, the relevant personnel involved in the registration shall keep it confidential.

Article 9 The validity period of a certificate of registration is 2 years, and the registration is due for review. If there is any change in the formula, trademark, packaging, and manufacturing process of imported consignment foods registered within the validity period, the application for registration shall be re-instated.

Article 10 The application for registration of health shall pay the registration fee, and the method of charging shall be separately provided.

Article 11 Violation of these Provisions, evading the supervision and inspection of health, the quality of imported consignment foods does not conform to the quality indicated in the application for registration or registration certificate, provision of false registration certificates and expired registration certificates, and sales outside the specified range does not conform to China's food hygiene standards. When consignment foods for consignments and regulations and the treatment of health departments are not adopted, they should be punished by the food hygiene supervision agency according to law in accordance with the seriousness of the circumstances, and the judicial department shall be held criminally liable for violation of the criminal law.

Article 12 The Ministry of Health shall be responsible for the interpretation of this provision.
